BBFS reserves the right to refuse entry and/or terminate membership if the following terms and conditions are not adhered to.
DRESS CODE
It is recommended that enclosed non slip footwear is worn at all times while in the studio.
LOCKERS
Lockers are available outside of the change rooms and are free of charge to members. BBFS takes no responsibility for the safe keeping of your personal belongings while you are using the facility. It is advised that you keep all valuables on you whilst in the studio. Please do not leave personal belongings such as bags lying on the studio floor as this poses a hazard to other members.
Loss of a locker key will incur a replacement fee, while damage to lockers will incur a fee identical to that of the repair.
LOST PROPERTY
BBFS does not take responsibility for the loss of or potential damage to your personal items while using the studio. BBFS will keep lost items for up to two weeks before disposing of them. Due to hygiene, water bottles found in the studio will be disposed of immediately.
HYGIENE & SAFETY
It is key that the studio is a safe and clean environment for all members. To maintain this, it is crucial that you wipe down all equipment after use with the anti-bacterial wipes made available.
PERSONAL INFORMATION & PHOTOGRAPHY
You acknowledge and agree that your personal information will be handled in accordance with The Hospital Research Foundation Group’s Privacy Policy, available at https://hospitalresearch.org.au/privacy-policy/
De-identified data including physical outcome measures and relevant health conditions may be used for research purposes. Medical history may also be discussed with relevant allied health professionals (physiotherapist, counsellor, occupational therapist, nurse practitioner) if a multidisciplinary approach will benefit your exercise prescription.
Medical history may be discussed with placement university students at BBFS completing their Exercise Physiology studies. All students agree to comply with confidentiality obligations prior to starting at the studio.
BBFS may use your photographs, images and/or video footage taken within the facility for promotional material. This may include social media (Instagram/Facebook), website material or promotional flyers. In the event you do not wish for this to occur, you agree to inform BBFS.
MEMBERSHIP CANCELLATION & SUSPENSION
A BBFS membership imposes a strict four-month minimum membership. Following this minimum four-month period, cancellation of your membership incurs no additional cost. If you can no longer attend BBFS during this four-month period due to a significant change in health, you may seek an exemption from this condition by providing a written letter to the BBFS manager outlining your change in circumstances.
BBFS must be notified at least 5 working days prior to your next scheduled membership debit if you wish to cancel or pause your membership. Any requested changes to your membership debit must be provided to BBFS via email. This includes pausing or cancelling your membership for any reason. BBFS will not refund payments if the required notice is not provided. BBFS will not refund upfront membership payments.
You may request to place your BBFS membership on hold, for example if you go on holiday. During this time no fees will be charged and you will not have access to the services. A rejoining fee is payable upon your return for any hold period of more than 4 weeks in total per calendar year.
If you have not attended BBFS for more than 12 weeks or have experienced a significant change to your health status, a re-assessment fee is payable to ensure we are providing you with a safe and effective exercise program. This reassessment will need to be completed before returning for your next exercise session.
BBFS reserves the right to suspend or terminate your membership at its sole discretion should BBFS reasonably believe that it is no longer safe for you to participate in activity at the studio.
EQUIPMENT
For your safety and the safety of other BBFS members, please seek assistance from a BBFS staff member to be taught how to correctly and safely operate all equipment within the studio.
PRIVATE CLIENTS
You can elect to enter into a Direct Debit Request Service Agreement with PaySmart to pay your BBFS membership fee. PaySmart will debit your nominated bank account or credit card.
If you choose not to sign up to the PaySmart direct debiting system, to reduce the administrative load we require a 6-month minimum upfront payment. This payment is non-refundable and no membership credit will be applied if you are away during this 6-month period.
FUNDING OPTIONS
NDIS and My Aged Care
BBFS can provide services to clients who wish to use their NDIS or My Aged Care funding. A service agreement must be in place before services can be provided. Invoices are issued following provision of a service. Full payment must be received within 14 days of the invoice date.
It is your responsibility to let BBFS know if the NDIS plan has been suspended, or replaced by a new NDIS plan, or you are no longer involved with the NDIS or My Aged Care. If an invoice is declined or payment is not received due to any circumstances, you will be required to pay for this service privately.
Department of Veterans’ Affairs (DVA)
DVA health cards (Gold and White) are accepted by BBFS as payment upon referral by your GP.
BBFS PLUS
BBFS also offers a one-on-one supported exercise service, either at the studio or in your own home. Additional terms apply. For services provided at home it is your responsibility to provide a clean, safe exercise and work environment and to ensure that personal equipment is regularly maintained.
MEMBER OBLIGATIONS
It is your responsibility to ensure your contact and payment details remain up to date to allow BBFS and PaySmart to contact you when required.
CHANGES TO TERMS AND CONDITIONS
BBFS reserves the right to amend and/or update these terms and conditions at any time. In the event that changes occur, BBFS will provide you with a minimum of one month’s notice of the changes.
WAIVER AND RELEASE OF LIABILITY
In consideration of BBFS allowing you to participate in activity at the studio (or in your home for BBFS Plus) you acknowledge and agree to the following.
- You warrant that you have obtained medical advice where appropriate regarding your participation in physical exercise. In addition, you agree to seek medical advice if requested by BBFS.
- You warrant that you will disclose all relevant information about your health status to BBFS and keep BBFS fully informed of your health status and ability to participate in physical exercise.
- You understand that there are inherent risks in all aspects of physical exercise and you acknowledge that you are fully aware of and accept all such risks.
- You understand that should you feel lightheaded, faint, dizzy, nauseated, or experience pain or discomfort, you are to stop the activity and inform the Exercise Physiologist immediately. You give BBFS permission to seek emergency medical services for you should you become injured or ill while exercising, with the understanding that you are responsible for any expenses incurred.
- You agree to waive any and all claims that you have or may have in the future against BBFS, Parkinson’s South Australia Inc. and its related entities including their directors, officers, employees, agents, volunteers and independent contractors (all of whom are hereinafter collectively referred to as “the Releasees”). You agree to release the Releasees from any and all liability for any loss, damage, claim, injury or expense that you may suffer, or that your next of kin may suffer as a result of your participation in the programs, activities and services provided by BBFS, due to any cause whatsoever.
- You agree to hold harmless and indemnify the Releasees from any and all liability for any damage to the property of, or personal injury to, any third party, resulting from your participation in any program, activity or service provided by the Releasees. This agreement shall be binding upon you, your successors, representatives, heirs, executors, assigns, or transferees. If any portion of this agreement is held invalid, you agree that the remainder of the agreement shall remain in full legal force and effect.
- You have read and understood these terms and conditions and are aware that by joining as a member of BBFS and agreeing to these terms and conditions you are waiving certain legal rights (including the right to sue for personal injury or death in any way caused by or relating to your participation in activity with BBFS) which you or your next of kin, executor, administers and assigns may have against the Releasees.
